The brief we were handed said you do not need a long haul flight to the Gulf to fill your bag, because Gibraltar is a 130 kilometre drive from Malaga airport and Dubai is seven hours in the air from London. That premise died on 1 October 2026, and not in the direction anyone expected. On that date Gibraltar's legal minimum price for a packet of 20 cigarettes rose by between 23 and 46 per cent depending on category. Not the average price. The floor, below which no shop in the territory is allowed to sell. So the straight answer to the question in the title has changed, and the useful answer was never about shelf prices at all. It is about the number printed on your allowance, which almost nobody checks until a customs officer asks. Dubai Duty Free is a shop. It sits airside at Dubai International and you can only reach it with a boarding pass. UAE VAT runs at 5 per cent and the Federal Tax Authority levies [excise at 100 per cent on all tobacco products](https://tax.gov.ae/en/media.centre/news/five.years.passed.since.the.implementation.of.excise.tax.in.the.uae.aspx) in the domestic market, which is why a packet bought in a Dubai supermarket is not cheap. Dubai Duty Free has said publicly that neither VAT nor excise applies to its airside sales, on the grounds that the goods go to passengers leaving the emirate. We could not find a Federal Tax Authority publication stating that in terms, so treat it as the retailer's position rather than a rule we have verified. Gibraltar is a jurisdiction. There is no VAT on the whole peninsula, which is the fact every shopping page repeats, and it is true. What those pages have not caught up with is that since the treaty began to apply on 15 July 2026 there is a transaction tax instead, and the Government's [technical notice on the customs union](https://www.gibraltar.gov.gi/press-releases/technical-notice-basic-features-of-the-customs-union-between-gibraltar-and-the-eu-722026-11670) sets it at 15 per cent in year one, 16 per cent in year two and 17 per cent from year three. Excise duties apply to exactly three things: tobacco, fuel and alcohol. So one is a tax free shop inside a taxed country. The other is a low tax country with one shop on every corner. They are not comparable in the way the question assumes, and the comparison only becomes answerable item by item. Gibraltar publishes minimum retail prices for four cigarette categories in the Gibraltar Gazette and reclassifies individual brands every three months. The latest set took effect on 1 October 2026 and was [reported by GBC](https://www.gbc.gi/news/retail-tobacco-prices-rise-by-23-46-per-pack-of-20-sept). The notices themselves are published quarterly on the [Laws of Gibraltar site](https://www.gibraltarlaws.gov.gi/legislations), which is where to look rather than at any travel page. One caution on sourcing: GBC's site intermittently refuses automated requests, so if that link will not load, open it in a browser. It is also the column the internet has wrong. Almost every page describing a Gibraltar tobacco run quotes 25 to 30 GBP for a carton of 200. As of 1 October 2026 the cheapest legal carton in the territory is 33.50 GBP and a premium brand cannot be sold below 54.40 GBP. Those pages are not lying. They are out of date by a matter of days, and so is a good deal of what you will read this month. There is a second mechanism behind the numbers, and it is the one that makes the old comparison permanently unwinnable. The technical notice sets a retail price differential: Gibraltar cigarettes may undercut the equivalent Spanish price by 0.80 EUR per pack or 15 per cent, whichever is the smaller figure. Gibraltar is still cheaper than Spain. It is now legally forbidden from being much cheaper, which is a more durable change than any single price rise. > The duty free gap on tobacco has not closed. It has been capped, measured and written into a treaty, which is harder to reverse than a tax rate. Here is the thing that makes the long haul argument collapse. Your allowance is set by where you are going, not by where you bought the goods. Fly home to Britain from Dubai and you are held to the same British limits as a passenger flying home from Gibraltar.
